These terms and conditions ("Terms") govern your use of our Website and the services offered by Open Art Night ("we," "our," or "us"). By using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website.
2. Services Open Art Night provides an online platform for artists to showcase and sell their artwork, and for customers to purchase artwork. When customers make a Deposit payment for a pice of art through our cart we will Notify the artist of the sale and that we have received a deposit from the customer of 20% commission by way of a deposit payment we charge at Open Art Night Ltd for exhibiting and selling your art work.
Please note that all prices are subject to change, and Open Art Night Ltd reserves the right to modify options and pricing over time. Additionally, it is important to mention that Open Art Night Ltd takes a Deposit payment of 20% commission on all artwork sold through our online gallery unless otherwise stated via a custom plan.
Gallery Subscription.
Upon purchasing your gallery subscription, we will reach out to coordinate the transfer of your digital artwork files to our gallery. The setup time for your artwork may vary, and the initial subscription fee covers these setup costs. Although we aim to showcase your artwork online within 5 days, please be aware that in some cases, this process may take longer.

Purchasing art.
Customer Purchases.
Once you purchase a piece of art it will be marked as sold or out of stock. We will inform the artist of this sale and we will give them your contact detail the artist will arrange shipping details with you so you can choose an option of your choice.you will then receive an invoice from the artist for the shipping costs balance & the remaining cost of the art less the deposit already paid to Open Art Night Ltd once you have paid for shipping & the Art Work to the artist the Art work will be shipped .Open Art Night Ltd is a platform for artists to show there work and sell once the payment is taken it is the artist and yourself who will complete the shipping & remaining Art costs transaction Open Art Nights can only be involved in the online sale deposit transaction and would re-fund your Deposit less the transaction fee in the event that you should cancel your order within 14 days cooling off period providing you have returned the art piece un damaged to the artist at your own cost After this time has lapsed we would not re-fund your Deposit without good reason you have consumer rights and can still challenge any part of the transaction via our contact us page
3. Purchases and Payments By making a purchase on our Website, you agree to pay the specified Deposit amount at checkout. The balance of the purchase price will be Paid direct to the artist as specified in the checkout process.You agree that any shipping cost and remaining cost of the art must be paid direct to the artist and you agree for Open Art Night Ltd to pass your contact details to the artist. We accept various payment methods, and all payments are subject to our Payment Policy, which can be found at [link to Payment Policy].
4. Artist Responsibilities If you are an artist selling your artwork on www.openartnight.co.uk, you agree to abide by our Artist Agreement, which outlines your responsibilities and obligations as a seller on our platform.
5. Customer Responsibilities If you are a customer making a purchase on our Website, you agree to abide by our Customer Agreement, which outlines your responsibilities and obligations as a buyer on our platform.
6. Shipping and Returns
All our art is shipped by the artist www.openartnight.co.uk do not ship any art we promote art and sell art by way of taking a deposit from the buyer any remaining amount of money owed to the artist must be paid direct to the artist Open art night Ltd can only be responsible for deposit amounts paid to our website and take no responsibility for any transactions between you the buyer and the artist outside of this website.
7. Intellectual Property All content on our Website, including artwork, text, graphics, logos, and images, is protected by intellectual property rights. You may not use, reproduce, distribute, or modify any content without our prior written consent or the consent of the respective owner.
8. Termination We reserve the right to terminate or suspend your access to the Website, with or without notice, for any reason, including if you violate these Terms.
9. Disclaimer of Warranties The Website and its content are provided on an "as-is" and "as-available" basis. We make no warranties, expressed or implied, regarding the Website's accuracy, reliability, or fitness for a particular purpose.
10. Limitation of Liability To the extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, resulting from your use of the Website or the purchase of artwork through our platform.
11. Event ticket sales all tickets for our events are sold to artists who wish to book a place in one of our Open Art Night Events by purchasing a ticket you agree to the terms on the ticket and you understand Open Art Nights take no responsibility for any lost or stolen tickets or art work it is your responsibility to keep your ticket and art work safe and undamaged you exhibit at your own risk.
Tickets can be refunded upto 2 days before the event after this time we will not re-fund your ticket as we would not have enough time for re-sale of your ticket. It is your responsibility to attend the event we do not re-fund tickets because you could not attend the event.
